PCMR Files Notice of Appeal to Keep Options Open

SAM Magazine—Park City, Utah, July 11, 2014—Park City Mountain Resort (PCMR) took the first step on Thursday in appealing the district court’s ruling on PCMR’s eviction from land owned by Talisker, filing a notice of appeal that the resort wishes to take the case to the Utah Supreme Court.

In a prepared statement, PCMR attorney Alan Sullivan termed the notice of appeal a “precautionary measure taken to protect PCMR’s appellate rights” in case the upcoming mediation effort fails to resolve the land dispute.

PCMR is keeping its options open as it seeks to negotiate a more favorable outcome to a decision district judge Ryan Harris made enforcing PCMR's eviction from much of its terrain. That decision came after a June 19 hearing and was put into effect by Harris' resulting order, issued July 1. That order was immediately stayed, though, pending the outcome of a mediation effort set for Aug. 15.
